Terms of Service

You must be at least 18 years old to use Kinku. The platform is intended for adults only and hosts tools and content related to fictional adult media creation.

You must provide accurate registration information and keep your account credentials secure. You are responsible for activity under your account.

Kinku is an AI creator platform that lets users train fictional characters, generate images and video, publish content, and interact with companions. Features may change, and we may add or remove functionality over time.

Kinku tokens are the in-platform credit system used for generation and unlocking certain content. Kinku tokens have no monetary value and are not a currency, security, or investment product. We may offer promotional redemptions or rewards at our discretion.

You retain ownership of content you create, subject to the licenses you grant below. You represent that you have the rights to upload reference material and publish content you share on Kinku.

By publishing on Kinku, you grant us a limited license to host, display, distribute, and technically process your content solely to operate the service — including storage on our infrastructure and delivery to users you authorize.

"Inputs" are everything you submit to a generation — prompts, uploaded reference photos, training images, video, audio, voice samples, character definitions, and the settings you choose. "Outputs" are everything the platform generates in response: images, video, audio, voiceovers, upscales, edits, variations, and companion messages.

As between you and Kinku, you own your Inputs. We claim no ownership in them and process them only to run the generation you requested and to enforce our Content Policy.

Subject to the conditions below, we assign you all rights we may hold in your Outputs, to the fullest extent permitted by law. You may use, modify, publish, distribute, and commercially exploit them — including posting them to subscription platforms and social networks, within those platforms' own rules. Where local law does not permit assignment of rights in AI-generated material, this operates instead as a perpetual, worldwide, royalty-free licence to use the Output for any lawful purpose.

That assignment is conditioned on three things: the Output was generated with Kinku tokens that were validly purchased or granted and whose payment has not been reversed, refunded, or charged back; the Output was generated in compliance with these Terms and our Content Policy; and your account was in good standing at the time. We assign no rights in any Output generated in breach of these Terms or the Content Policy — including any Output depicting a real person without documented consent, any Output produced by evading our safety systems, and any Output falling within a prohibited category. Such Outputs are unlicensed, and any use of them is unauthorised.

Outputs generated with free, trial, or promotional tokens are licensed for personal, non-commercial use only unless we state otherwise on the applicable plan.

You warrant that you hold all rights, licences, releases, and consents needed for every Input — including documented consent from any person whose face, body, voice, or likeness is identifiable in it, and including 2257-compliant records where applicable. You are solely responsible for any claim arising from an Input or from an Output generated from one.

Outputs are not exclusive. Models are probabilistic, and another user working from a similar prompt or reference may receive a substantially similar Output. We do not guarantee uniqueness, we will not police similar Outputs generated by others, and owning an Output gives you no claim against a user who independently generates something like it.

The copyright status of AI-generated material is unsettled and varies by jurisdiction. In the United States and elsewhere, material generated without sufficient human authorship may not be eligible for copyright at all. We assign only the rights we actually hold and make no representation that any Output is protectable, registrable, or enforceable against third parties.

We do not indemnify you for Outputs. We do not screen, endorse, or vouch for generated material, and we make no representation that an Output is clear of third-party rights. Clearing an Output before you publish it is your responsibility.

We do not use your Inputs or Outputs to train foundation AI models, and we do not sell or license them to third parties for model training. Some features run on models operated by third parties; their licence terms apply to Outputs generated with them and are incorporated here by reference, and those providers may change, restrict, or withdraw a model without notice to us.

You are responsible for complying with any law, platform policy, or advertising rule that requires AI-generated media to be labelled or disclosed. We may embed provenance metadata or content credentials in Outputs, and you may not remove or obscure them.

• You may not use Outputs, Inputs, or data derived from the platform to train, fine-tune, distill, or develop another AI model or dataset
• You may not resell or sublicense access to the platform or to raw model capacity, or build a competing generation service on top of it
• You may not present an Output as an authentic, unaltered recording of a real person or event where doing so would deceive a viewer or break the law
• You may not register an Output as a trademark or brand identity element

You may not use Kinku to create, upload, solicit, or distribute prohibited content or to engage in prohibited conduct. See our Content Policy for detailed rules.

• Content involving minors or age-ambiguous subjects
• Non-consensual sexual imagery of real people, including deepfakes without documented consent
• Celebrity or real-person sexual impersonation
• Revenge, coercion, or hidden-camera style non-consensual scenarios
• Illegal material of any kind
• Malware, spam, scraping, or attempts to bypass safety systems
• Impersonating Kinku staff or other users

We may remove content, suspend accounts, or terminate access if we believe you violated these Terms, our Content Policy, or applicable law. We may cooperate with law enforcement when required.

Certain purchases may be processed by third-party payment providers. Their terms apply to those transactions. Bringing your own API keys for generation is subject to your provider's terms as well.

Links to third-party platforms (subscription sites, social networks) are not endorsements. You are responsible for compliance when posting Kinku-generated content elsewhere.

Kinku is provided "as is" without warranties of uninterrupted service, error-free generation, or fitness for a particular purpose. AI outputs may be inaccurate or unexpected.

To the maximum extent permitted by law, Kinku and its operators are not liable for indirect, incidental, or consequential damages arising from your use of the service.

We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance. Material changes may be communicated via the site or email where appropriate.
